Donald Trump’s big victory in the Supreme Court! Judges’ power to ‘stop action’ in America has been curbed
US President Donald Trump has received a major relief from the Supreme Court. On Friday, the US Supreme Court delivered a 6-3 majority verdict that has raised questions on the power of lower courts to stop Trump’s policies across the country. This verdict is being considered a milestone in the way of advancing Trump’s policy agenda. This case is related to Trump’s executive order in which he tried to end the system of granting citizenship to children born in America. This order applies especially to those children whose parents are not American citizens or who do not have a green card.
Trump issued this executive order on the very first day of his return to the presidency. According to this, now a child born in America will get citizenship only if at least one of his parents has American citizenship or legal residence (green card).
Debate on the 14th Amendment
Trump’s order was said to be against the 14th Amendment, which says that ‘all persons born in the United States, and within the jurisdiction thereof, shall be citizens of the United States’. This amendment was implemented in 1868 after the Civil War and was brought to ensure citizenship after the abolition of slavery.
Democratic attorneys general from 22 states, immigrant rights activists and several pregnant immigrant women had challenged Trump’s order in court.
What did the Supreme Court say?
Although the Supreme Court has not yet given any final decision on the constitutionality of this order, the court did say in support of Trump that the lower courts are going beyond the authority to issue a “nationwide injunction”.
Justice Amy Coney Barrett, who was appointed to the Supreme Court by Trump, wrote in the majority decision, “Federal courts are not given a general authority to supervise the executive branch. They have only those powers that Congress has delegated to them.” She further said, “If the court believes that a policy of the executive branch is illegal, it does not mean that it should overstep its boundaries.”
Trump’s response and impact
This decision clears the way not only for Trump’s current policies, but also for future presidents and governments. Welcoming the decision, US Attorney General Pam Bondi wrote on Twitter (formerly Twitter), ‘The Supreme Court today directed the district courts to stop the flood of nationwide injunctions against President Trump. This would not have been possible without the hard work of our Justice Department and Solicitor General John Sawyer.’ She also added that the Justice Department will continue to fight to protect Trump’s policies and rights.
This decision has brought a major turn in the US judicial system. This is a clear message that lower courts can no longer give orders applicable to the whole country, especially when the matter is related to the policy of the executive. Many of Trump’s decisions like immigration, budget cuts, and control over agencies were stopped by the lower courts. But now the Supreme Court has made it clear that there is a limit to the powers of the lower courts.
